Alhaji Abubakar Atiku, the presidential candidate for the Peoples Democratic Party (PDP), has petitioned the Supreme Court to overturn the Presidential Election Petition Court’s September 6 ruling, which upheld Bola Ahmed Tinubu’s declaration as the winner of the 2023 presidential election.
In his 35-point Notice of Appeal, Atiku argued that the tribunal’s findings and conclusion in the petition challenging Tinubu’s declaration as President by the Independent National Electoral Commission, INEC constituted grave error and miscarriage of justice.
Atiku’s primary attorney, Chief Chris Uche, SAN, recently filed a Notice of Appeal, asking the Supreme Court to overturn the Tribunal’s findings and conclusions on the grounds that they misrepresented the nature of his case.
The former Vice President argued, among other things, that the Tribunal committed an error of law when it failed to nullify the presidential election held on February 25, 2023, on the grounds of non-compliance with the Electoral Act, 2022, when, according to evidence presented to the tribunal, INEC conducted the election based on grave and gross misrepresentation contrary to the principles of the Electoral Act 2022 and based on the “doctrine of legitimate expectation.”
